AUSTIN -- A federal judge has put the pause button on a state law banning a common second-trimester abortion procedure the day before it was set to go into law. District Judge Lee Yeakel issued a temporary restraining order Thursday, halting implementation of the law meant to go into effect Sept.

The state will work to protect its right to protect "the basic human rights and dignity of the unborn," Republican Attorney General ken Paxton's office said in a statement. Both sides are expected back in court Sept. Abortion providers who brought the suit argue the dilation and evacuation procedure is the "safest and most common" method for terminating a pregnancy after 15 weeks and contend the law would create an undue burden for women.

Advocates for the law say the second-trimester procedure -- known as dilatation and evacuation -- is cruel an inhumane, although abortion providers say the procedure is the safest for women in the second term of their pregnancy. Texas Right to Life, one of several anti-abortion groups in the state, said the ban was its "top priority" for this year's legislative session.

Supporters of the law argue the procedure is brutal and could work to undermine the legal underpinnings of Roe v. Wade in a larger battle to end abortion. The suit is one in a long series of legal challenges to the state's abortion laws. The U. Srate Court last summer threw out provisions of state law that required abortion clinic facilities meet the same standards as ambulatory surgical centers and require their physicians to gain admitting privileges at a nearby hospital. Half of the state's abortion clinics closed in the three years it took the law to to wind through the courts.
