Criminal lawyer owed client duty of care regarding advice on civil matter
Join today! Already a subscriber? A New York appellate Nefligence held that a criminal attorney owed his client a duty of care regarding advice he allegedly gave the client in a civil matter. Criminal attorney Anthony Siano represented Jay Katz in a criminal matter, and the parties signed a retainer agreement. Katz later sued Siano, alleging legal malpractice, Law Professional Negligence the attorney moved to dismiss. The trial court denied the motion.
Affirming, the appellate court found that the plaintiff adequately pleaded that the defendant had owed him a duty of care regarding legal advice that he allegedly offered the plaintiff on a pending civil action. Consequently, dismissal was not warranted.
